This Agreement is between you and CarRentals.com, Inc., a Nevada corporation, its subsidiaries and corporate affiliate, (together, "CarRentals" or "us" or "we") and governs your use of the CarRentals Skill on Amazon's Alexa service on any Alexa-enabled device (the "Skill"). The Agreement applies in addition to, and is not intended to replace, any other agreement that may apply in connection with your CarRentals account or the use of the Skill.
Before using the Skill, please read these Terms and Conditions, the CarRentals.com Terms of Use, and the CarRentals.com Privacy Policy (collectively, the "Agreement").
Your use of the Skill is conditioned on your acceptance of this Agreement. If you don't accept these terms, you may not use the Skill.
1. Privacy and Security: The Skill allows you to use your Alexa-enabled device to communicate with CarRentals, by voice, regarding your Account(s). Your voice is only used to activate Alexa's features and is not used to authenticate the account. To use the Skill, you will have to speak commands and questions aloud to Amazon's Alexa service ("Alexa"), and you will receive responses aloud. Any communication to CarRentals via Alexa will be treated by CarRentals as a communication authorized by you, and any communication from CarRentals via Alexa in response to a request received from your Alexa-enabled device will be treated by CarRentals as a communication to you. For example, it is possible that someone other than you could interact with CarRentals via the Skill, or that someone could overhear you interacting with CarRentals via the Skill and learn information about your Account(s). It is also possible that Alexa (and the equipment Alexa is installed on) and/or Amazon will record your interactions with the Skill or with Alexa. Consult your agreements with Amazon to learn more about how Amazon and your Alexa-enabled device treat those interactions.
2. Transactions Using the Alexa Skill: You are responsible for all interactions with CarRentals via the Skill, and you authorize any transactions made using the Skill once you have enabled it.
3. Third-Party Security Settings: Once you set up your Alexa device with the Skill, you are authorizing CarRentals to provide information to the device based on the device's security settings. For example, the settings on your device may allow the device to retrieve information about your Account(s) based on only verbal requests from anyone who uses your device, or to save information about your Account(s) for easier access. By enabling the Skill on your Alexa-enabled device, you are responsible for how the Skill is used (including any communication to or from CarRentals from your device).
4. Accuracy: We didn't design or manufacture Alexa or your Alexa-enabled device. The device also runs other software (e.g., Alexa and other third-party apps) that we did not write or design and do not have control over. It's possible that Alexa will not hear you correctly, will incorrectly translate what you said, or even say something to you different than the information we provided to Alexa. By accepting this Agreement, you understand and agree that CarRentals is not responsible for inaccuracies in your interactions with CarRentals via the Skill. If you have any issues or doubts about the accuracy of your interactions with CarRentals via the Skill, you can still get your Account details all the same ways you were used to before you got fancy with newfangled technology (including using the CarRentals mobile application(s) or logging on to your Account(s) on our website at www.capitalone.com.
5. Hardware and Other Requirements: To participate in this pilot and access CarRentals via the Skill, you must (1) have an active CarRentals Account; (2) be an 18 years of age or older legal resident of the 50 United States or the District of Columbia 18 years of age or older, and (3) have an Alexa-enabled device, an internet connection, and an Amazon account. You cannot use the Skill otherwise.
6. Release of Your Information to Amazon: Your interactions with CarRentals via the Skill are subject to the CarRentals Privacy Policy. By installing the Skill, you are authorizing CarRentals to perform the actions and/or share with Amazon the information communicated to CarRentals, or requested from CarRentals. We're going to send that information through Amazon, which will then go through the internet.
7. Changes or Amendments: We may change, suspend, or discontinue the Skill, or any part of it, at any time without notice. We may amend any of this Agreement's terms at our sole discretion by posting the revised terms on our website at https://www.carrentals.com/terms/. Your continued use of the Skill after the effective date of the revised Agreement constitutes acceptance of the terms.
8. Termination: Your rights under this Agreement will automatically terminate without notice if you fail to comply with any of its terms. In case of such termination, we may immediately revoke your access to the Skill.
9. Disclaimer of Warranty: Just in case this isn't clear yet, you acknowledge and agree that all use of the Skill is at your sole risk. YOU ASSUME ALL RISK FOR YOUR USE OF THE SKILL, THAT IT IS PROVIDED "AS IS", AND THAT CARRENTALS MAKES NO WARRANTY OR REPRESENTATION, EITHER EXPRESS OR IMPLIED. CARRENTALS EXPRESSLY DISCLAIMS ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM CARRENTALS, OR THROUGH OR FROM THE SKILL, WILL CREATE ANY WARRANTY OF ANY KIND.
10. CarRentals is committed to customer satisfaction, so if you have a problem or dispute, we will try to resolve your concerns. But if we are unsuccessful, you may pursue claims as explained in this section. You agree to give us an opportunity to resolve any disputes or claims relating in any way to the Website, any dealings with our customer service agents, any services or products provided, any representations made by us, or our Privacy Policy ("Claims") by contacting CarRentals Customer Support or 1-844-228-3218. If we are not able to resolve your Claims within 60 days, you may seek relief through arbitration or in small claims court, as set forth below.
Any and all Claims will be resolved by binding arbitration, rather than in court, except you may assert Claims on an individual basis in small claims court if they qualify. This includes any Claims you assert against us, our subsidiaries, travel suppliers or any companies offering products or services through us (which are beneficiaries of this arbitration agreement). This also includes any Claims that arose before you accepted these Terms of Use, regardless of whether prior versions of the Terms of Use required arbitration.
There is no judge or jury in arbitration, and court review of an arbitration award is limited. However, an arbitrator can award on an individual basis the same damages and relief as a court (including statutory damages, attorneys' fees and costs), and must follow and enforce these Terms of Use as a court would.
Arbitrations will be conducted by the American Arbitration Association (AAA) under its rules, including the AAA Consumer Rules. Payment of all filing, administration and arbitrator fees will be governed by the AAA's rules, except as provided in this section. If your total Claims seek less than 10,000, we will reimburse you for filing fees you pay to the AAA and will pay arbitrator's fees. You may choose to have an arbitration conducted by telephone, based on written submissions, or in person in the state where you live or at another mutually agreed location.
To begin an arbitration proceeding, you must send a letter requesting arbitration and describing your Claims to "Expedia Legal: Arbitration Claim Manager," at Expedia, Inc., 333 108th Ave N.E. Bellevue, WA 98004. If we request arbitration against you, we will give you notice at the email address or street address you have provided. The AAA's rules and filing instructions are available at www.adr.org or by calling 1-800-778-7879.
Any and all proceedings to resolve Claims will be conducted only on an individual basis and not in a class, consolidated or representative action. If for any reason a Claim proceeds in court rather than in arbitration we each waive any right to a jury trial. The Federal Arbitration Act and federal arbitration law apply to this agreement. An arbitration decision may be confirmed by any court with competent jurisdiction.
11. Trademark Information: CarRentals trademarks and graphics used in connection with the Skill are the property of CarRentals. All other trademarks and graphics used are the property of their respective owners.
